Giveaway Terms

These promotional giveaway terms (the “Giveaway Terms”) governs your participation in any promotional giveaway, competition, or prize draw (each a “Giveaway”) organised or otherwise sponsored by Yousician Ltd., a Finnish entity specified below in section “Contact us” (hereinafter, “Yousician” or “us/we/our”).

These Giveaway Terms form supplemental terms to our Terms of Service (the “Terms of Service”) and are incorporated into the agreement between you and Yousician. In the event of a conflict between these Giveaway Terms and the Terms of Service, these Giveaway Terms shall prevail to the extent of such conflict.

If a specific Giveaway is subject to additional or deviating conditions, such conditions will be communicated in the relevant Giveaway announcement and shall prevail over these Giveaway Terms to the extent of any conflict.

By participating in any Giveaway, you agree to be bound by these Giveaway Terms.

1. ELIGIBILITY

Unless otherwise stated in the relevant Giveaway announcement, participation is open to natural persons who:

  • are at least eighteen (18) years of age at the time of entry;
  • reside in the European Union or the European Economic Area, or in such other country or countries as specified in the Giveaway announcement;
  • are not employees, officers, or directors of Yousician or its affiliated companies, or members of their immediate families or households; and
  • where specified in the Giveaway announcement, hold an active, paid subscription to such Yousician service and for such time period as stated therein.

We reserve the right to verify eligibility and to disqualify any participant who does not meet the applicable criteria.

2. HOW TO ENTER

Participation in a Giveaway is free of charge. No purchase is required to enter unless expressly stated otherwise.

Entry shall be made by following the instructions set out in the relevant Giveaway announcement within the stated entry period. Unless otherwise stated, each participant may enter only once per Giveaway. Multiple entries by the same person may result in disqualification at our discretion.

We are not responsible for entries that are lost, delayed, misdirected, or incomplete due to technical failures or circumstances beyond our reasonable control.

3. WINNER SELECTION AND NOTIFICATION

The method of winner selection (for example, random draw or jury decision) and the timeline for selection will be specified in the relevant Giveaway announcement.

Winners will be notified by the method and within the timeframe stated in the Giveaway announcement. If a winner cannot be reached or fails to respond within seven (7) calendar days of the initial notification (or such other period as stated in the Giveaway announcement), we reserve the right to select an alternative winner.

4. PRIZES

The prize(s) for each Giveaway will be described in the relevant Giveaway announcement. Prizes are personal and non-transferable unless expressly stated otherwise. Prizes may not be exchanged for cash or other alternatives.

We reserve the right to substitute a prize of equivalent or greater value if the original prize becomes unavailable for reasons beyond our reasonable control.

5. TAXES

Any taxes, duties, customs, levies or other public fees applicable to a prize shall be the sole responsibility of the winner, unless otherwise required by mandatory law.

6. PERSONAL DATA

We process participants’ personal data in accordance with Regulation (EU) 2016/679 (the “GDPR”) and applicable national data protection legislation. The personal data collected for the purpose of administering a Giveaway will be processed on the basis of your consent or our legitimate interest in administering the Giveaway.

Personal data will not be retained longer than is necessary for the administration of the Giveaway, including prize fulfilment and any legal obligations arising therefrom. For further information on how we process your personal data, please see our Privacy Notice.

7. PUBLICITY

By entering a Giveaway, you agree that we may publish details, such as the winner’s first name, last initial, and city of residence for the purpose of announcing the Giveaway results. We will not use the winner’s name or likeness for further marketing purposes without the winner’s prior consent.

8. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, YOUSICIAN SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER SIMILAR DAMAGES ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN A GIVEAWAY OR THE ACCEPTANCE, POSSESSION, OR USE OF A PRIZE, INCLUDING BUT NOT LIMITED TO:

  • technical failures, errors, or disruptions affecting the entry process;
  • any acts or omissions of third parties, including but not limited to event organisers, delivery services, or platform providers; or
  • any loss or damage to property or personal injury arising from the prize.

Some jurisdictions do not allow certain limitations of liability such as those stated above; thus, the above terms may not apply to you. Instead, in such jurisdictions, the foregoing limitations of liability shall apply only to the extent permitted by the laws of such jurisdictions.

9. DISQUALIFICATION

We reserve the right to disqualify any participant who:

  • violates these Giveaway Terms or any applicable Giveaway-specific conditions;
  • engages in fraudulent, dishonest, or abusive conduct in connection with the Giveaway;
  • tampers with the entry process or the operation of the Giveaway; or
  • fails to meet the eligibility requirements set out in Section 1.

10. CHANGES AND CANCELLATION

We reserve the right to modify, suspend, or cancel a Giveaway at any time if circumstances beyond our reasonable control make it necessary or if the integrity of the Giveaway is compromised. In such an event, we will use reasonable efforts to notify participants and shall not be liable for any loss arising from such modification, suspension, or cancellation.

11. GOVERNING LAW AND DISPUTE RESOLUTION

If a dispute arises between you and Yousician in connection with a Giveaway, we strongly encourage you to first contact us directly through our support site http://support.yousician.com/ and seek resolution.

The laws of Finland, without regard to or application of its conflict of law provisions, will govern these Giveaway Terms and you agree that any claim or dispute you may have against Yousician in connection with a Giveaway must be resolved exclusively by the Helsinki District Court.

If you are a consumer residing in the EU, you may utilise the European Commission’s Online Dispute Resolution (ODR) platform, available at ec.europa.eu/odr, to resolve disputes out of court. Additionally, you have the option to seek alternative dispute resolution by referring your case to a consumer disputes board or another relevant out-of-court body in your country of residence.

13. CHANGES TO THESE GIVEAWAY TERMS

In response to changing legal, regulatory, technological or business developments, Yousician reserves, at its discretion, the right to change, modify or remove parts of these Giveaway Terms at any time by posting the amended terms on the Yousician website or by any other method of notice we deem appropriate. The version in effect at the time of your entry into a Giveaway shall apply to that Giveaway.
